On 12 July 2016 the European Commission adopted the EU-US Privacy Shield, with immediate effect. The press release on and full text of the decision are available on this webpage. The Privacy Shield is a new framework for transatlantic data flows, which replaces the invalidated Safe Harbor mechanism.
Purpose of the new framework is to ensure the protection of the fundamental rights of European citizens where their data are transferred to the US, and at the same time it should provide legal certainty for businesses. The US Department of Commerce also published a guidance on how organizations can join the Privacy Shield, and will begin accepting self-certifications from 1 August 2016.
